General terms and conditions - as of 08/2022


For all orders via our online shop by consumers, the following General Terms and Conditions (GTC) apply exclusively in the respective version at the time of the order. Deviating terms and conditions of the customer will be rejected. We only sell to consumers.

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

As to § 19 UStG we are exonerated of VAT and not obliged to indicate the VAT amount.

Contractual partner, conclusion of contract

The purchase contract is concluded with MS Management, represented by Michaela Sittsam.

By placing the products in the online shop, we are submitting a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. The contract is concluded when you click on the order button to accept the offer for the goods in the shopping cart. By submitting the order, you accept our terms and conditions.

Immediately after submitting the order, you will receive a confirmation by email.

A binding contract can also be concluded beforehand as follows:

If you have chosen to pay by credit card, the contract is concluded when the credit card is charged.

If you have chosen a different payment method, the contract will be concluded at the time of debiting your account.

The languages available for the conclusion of the contract are German, French and English.

Delivery conditions, total purchase price, delivery times

In addition to the indicated product prices, shipping costs may be added. The amount of the shipping costs is indicated on the respective product pages.

Our prices are gross prices. As to § 19 UStG we are exonerated of VAT.

We source our goods from abroad and only deliver from Germany.

We only deliver by Post and Parcel services. Picking up the goods yourself is only possible in exceptional cases.

The delivery time is in average 7-10 working days, in some cases up to 30 working days. If you have not received your order after 30 working days, we will refund you the full purchase price. In the event of force majeure, longer delivery times may apply. For the current delivery times, please refer to the information on the respective product page.

Should an item not be available anymore, we inform you immediately about the non-availability and we will reimburse you the amount paid. 

Our website is available in three languages: German, French and English. We deliver to several countries within the EU. If you agree to our terms and conditions, you also agree that you have read and understood our terms and conditions in German or French or English.

Payment, due date

Payment of the purchase price is due upon conclusion of the contract. The delivered goods remain the property of MS Management until they have been paid for in full.

Refund policy, cancellation and complaints

Right of withdrawal from contract

As a consumer, you have the right to withdraw from the contract with us within 30 days without giving any reason. The withdrawal period is 30 days from receipt of the product by you or a third party who is not the carrier. In order to exercise your right of withdrawal as a consumer, you can inform us by means of a clear declaration (e.g. a letter sent by post or by e-mail). You can use the sample form, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send the written notification that you are exercising your right of cancellation before the cancellation period has expired.

The following applies to Germany and all countries: If you have received the goods, please return the article (s) you have ordered in the original packaging and undamaged to the following address: MS Management, Beverwijker Ring 12, D-56564 Neuwied. We bear the costs of returning the goods. In this case, you will receive a return postage by e-mail. Please return the goods to us immediately and in any case within 30 days after you have informed us of the cancellation of this contract. After receiving the goods, we will refund you the full purchase price within 7 working days after we have received the goods and they are intact and in their original condition. For the reimbursement, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed. Under no circumstances will you be charged any fees for this reimbursement.


If the goods received are defective or faulty, please inform us immediately by e-mail to We will contact you as soon as possible to either send replacement goods or to reimburse you for the costs.

Retention of title

The goods remain our property until full payment.

Transport damage

If goods are delivered with obvious transport damage, please report such errors to the deliverer as soon as possible and contact us immediately. Failure to lodge a complaint or to contact you has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to assert our own claims against the carrier or transport insurance.

Product presentations on photos or videos

We strive to present the products as authentically as possible. However, due to different screen settings or lighting conditions, it is possible that the color of the product or general aspects cannot be faithfully reproduced. A slight color deviation is not a reason for complaint. By agreeing to our terms and conditions, you accept a slight color deviation.

Warranties and guarantees

The statutory German law on liability for defects applies to all defects and complaints.

If the delivered item is defective, we initially provide our customers with a guarantee, at our discretion, by eliminating the defect (subsequent improvement) or by delivering a defect-free item (replacement delivery).

The above restrictions and shortened deadlines do not apply to claims based on damage caused by us, our legal representatives or vicarious agents.

  • in the event of injury to life, body or health
  • in the event of willful or grossly negligent breach of duty as well as malice
  • in the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and compliance with which the contractual partner may regularly rely (cardinal obligations)
  • as part of a guarantee promise, if agreed
  • as far as the scope of the product liability law is opened.

We endeavor to resolve disputes with consumers, but are not obliged to participate in a dispute settlement procedure before a consumer arbitration board.


We are always unrestrictedly liable for claims based on damage caused by us, our legal representatives or vicarious agents

  • in the event of injury to life, body or health
  • in the event of willful or grossly negligent breach of duty
  • in the case of guarantee promises, if agreed
  • as far as the scope of the product liability law is opened.

In the event of a breach of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner may regularly rely (cardinal obligations), due to slight negligence on the part of us, our legal representatives or vicarious agents, the amount of liability is based on the amount at the time the contract was concluded foreseeable damage that can typically be expected to occur. Otherwise claims for damages are excluded.

Online dispute resolution

If you are a consumer according to § 13 BGB (German law), you have the option in the event of a dispute on the EU portal "Your Europe" to carry out an online arbitration procedure with the assistance of a recognized arbitration body. Choice of law and place of jurisdiction

The law of the Federal Republic of Germany applies to the contractual relationships between the supplier and the customer. The mandatory consumer protection regulations of the country in which the customer has his habitual residence are excluded from this choice of law. The application of the UN sales law is excluded.

The place of jurisdiction for all disputes arising from the contractual relationship between the provider and the customer is the provider's registered office.

Severability clause

Should a provision of these general terms and conditions be ineffective, the effectiveness of the remaining provisions will not be affected.
